These Terms of Service govern your access to and use of the CollideScope application and services (collectively “CollideScope Services”). They govern any content accessed or created by you or a third party in relation to the CollideScope Services. Each user’s access to the CollideScope Services is conditioned upon the acceptance and compliance with these Terms of Service and your continued use of CollideScope Services constitutes an agreement to be bound by these Terms of Service.
You are solely responsible for all content you create or otherwise post for use on any CollideScope Services, including but not limited to text, pictures, sounds and video. You consent that any content you post to CollideScope Services is intended for use and consumption by other users or the public and is not private, personal or confidential. CollideScope and its parents, subsidiaries, affiliates, related companies, officers, directors, employees, agents, investors, representatives, partners and licensors (the “CollideScope Group”) are not responsible for any content that is lost, deleted or otherwise made inaccessible for any reason. All content posted or viewed by use of CollideScope Services or any third party service is the responsibility of the posting party. The CollideScope Group may not monitor and control the content posted and is not responsible for its authenticity, truthfulness, appropriateness, impact or consequences. Use or reliance in any manner on posted content is at your own risk, even if posted content is deceptive, offensive or fraudulent. You consent and agree to read and abide at all times by the Terms of Service and Privacy Policies of each social network or third party service provider to which you connect through CollideScope Services.
You consent and provide authorization for the CollideScope Services to access your contact list, your photo gallery and your camera for purposes of utilization of social network services. You also consent and provide authorization for CollideScope Services to send notifications and invitation on your behalf to users you wish to connect with.
You are only authorized to use CollideScope Services if you are legally capable of entering into a binding contract and be bound by these Terms of Service. If you are accepting these terms of service on behalf of a legal entity distinct from an individual, by accepting these terms of service, you represent you have authority to act on behalf of that legal entity. You may only use CollideScope Services in compliance with all applicable laws and regulations, at any level, of jurisdiction to which you are subject.
CollideScope Services may change or evolve over time, or stop providing services and you consent to these changes and alterations without being provided prior notice. You expressly consent to receive communications, updates and notices from the CollideScope Group or its partners and affiliates about CollideScope Services.
You consent that CollideScope Services may contain advertisements that use information provided by you or is generated from your CollideScope Services activity.
Except as is contradicted by the terms of service of any social network to which you connect through CollideScope Services, you retain your rights to any content you post, except to the extent you grant a worldwide, non-exclusive, royalty-free license with the right to sub-license for use, copy, reproduction, process, adapt, modify, publish, transmit, display and distribute such content in any way on any medium. You consent that any use of content you post no matter what value it brings CollideScope, its partners, affiliates or other third party service provider accessed through CollideScope Services will result in no compensation to you. By posting content you represent that you have the right and authority to post such content and to the extent liability is created as a result of your post, you are solely responsible for that liability and expressly indemnify the CollideScope Group.
The CollideScope Group reserves all rights to remove any Content, for any reason, including but not limited actual or alleged copyright violation, at any time related to any CollideScope Services as well as to suspend or terminate users and/or accounts, in part or in full. By agreeing to these terms, you consent to allow the CollideScope Group to access, read, and disclose information which is reasonably believed to be necessary to address applicable law, fraud or technical issues and protect rights and safety of the CollideScope Group or its users.
By agreeing to these terms you agree not to access or tamper with non-public CollideScope Services and otherwise breach or circumvent any security or authentication measures whether by actual breach or attempt.
Aside from any rights which you may have which may not be lawfully limited, the following limitations are imposed up to the extent allowable by law: the CollideScope Group disclaims all warranties and conditions, including those that are express or implied as well as those of merchantability and fitness for a particular purpose. No statement made in anyway, including in these terms, in another writing or orally or implied is intended to be a warranty or representation by the CollideScope Group related to availability, security or reliability of the CollideScope Services or content. The CollideScope Group disclaims all liability for harm to your computer system and phone, loss of data or other harm suffered as a result of the use or interaction with CollideScope Services. The CollideScope Group is not responsible for, or any way liable for information or conduct related to any third party services linked to or used by CollideScope Services. The CollideScope Group is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of use, data or good will, or any other intangible loss resulting from the provision or lack thereof of CollideScope Services.
You consent to WAIVE YOUR RIGHTS under any statue or rule providing for the ability to participate in a class action against any entity within the CollideScope Group as it relates to any CollideScope Services.
Failure to enforce a particular term in these terms by CollideScope is not intended to waive the terms and if any individual terms is deemed unenforceable, then that provision is severed while the remainder of the terms continue in full force and effect. These terms and any action related to or against the CollideScope Group based upon the provision or lack thereof of CollideScope Services shall be governed by the laws of the State of California. All claim arising from any CollideScope Services must be brought in a competent jurisdiction in the State of California and you hereby consent to jurisdiction and venue of State or Federal Courts in California for all purposes.
